Acceptable Use Policy

This Acceptable Use Policy (“AUP”) sets out the policies and rules to be adopted by you in relation to your use of the Services. Where a matter is specified in detail that does not mean that there are not other matters to which the same provisions apply.

This AUP is part of our terms and conditions and should be read in conjunction with them. Words appearing in this AUP starting with a capital letter shall have the same meaning as defined in our terms and conditions, unless the context otherwise requires.


1. Introduction

You acknowledge that:

 

1.1.

we reserve the right to remove any material from your Web site or elsewhere (without liability to us), which we deem (in our sole discretion) to violate this AUP;

 

1.2.

we reserve the right to modify or otherwise amend this AUP without notice. If we do so, we will post the amended version on our Web site, whereupon it becomes effective and binding on you as soon as you have seen it, or four weeks from the date of our posting it, whichever is the sooner.

2. Our Policy

 

2.1.

You must not (and you must ensure that others with access to the Services will not) use, in any way, the Services to transmit, distribute, or display any material which:

2.1.1.

violates any applicable law or regulation, including without limitation:

material protected by copyright, trademark, trade secret or intellectual property right used without proper authorisation and

material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

2.1.2.

is (in our sole opinion) harmful, threatening, abusive, malicious, tortuous, defamatory, obscene, indecent, invasive of another’s privacy, misleading, fraudulent, hateful, inflammatory, discriminatory or otherwise objectionable.

 

2.2.

You must not (and you must ensure that others with access to the Services will not) use, in any way, the Services to:

2.2.1.

send duplicative or unsolicited advertising material or bulk messages or any other type of ‘SPAM’ or ‘Junk Mail’ (commercial or otherwise), including without limitation, ‘chain letters’ or ‘pyramid schemes’, or to collect the responses from such messages;

 

2.2.2.

post advertisements or messages that violate the rules of any newsgroup or mailing list or that contain outrageous content in order to generate numerous responses;

 

2.2.3.

subscribe someone else to a mailing list without their permission;

 

2.2.4.

falsify address information, headers or other identifiers to disguise the true source of any message or to forge any other TCP/IP packet;

 

2.2.5.

to create, attach, upload or knowingly transmit messages which contain a virus or other potentially harmful or destructive computer code, files or programmes.

 

2.3.

You must not gain or attempt to gain unauthorised access to, or use of any data, system, network or account, or to interfere with service to any user, system or network, including without limitation:

2.3.1.

breeching any authentication or security measures;

 

2.3.2.

probing, scanning or testing the vulnerability of any system or network;

 

2.3.3.

monitoring or intercepting the transmission of any data or traffic on any system or network;

 

2.3.4.

mail-bombing, flooding, attempting to overload a system, broadcasting attacks and any other activity designed to cause a system crash.

 

2.4.

You must not (and ensure that others with access to the Services will not):

2.4.1.

use any third party or third party services to send duplicative or unsolicited advertising material or bulk messages or any other type of ‘SPAM’ or ‘Junk Mail’ (commercial or otherwise), or to post advertisements or messages that violate the rules of any newsgroup, to advertise Web sites or other URLs that point to files hosted by us;

 

2.4.2.

run any programmes or scripts that overload, consume excessive amounts of memory or processor time or otherwise disrupt our services or systems;

 

2.4.3.

upload files that (in our sole opinion) could cause any of our services or systems to become unstable;

 

2.4.4.

store excessive numbers of files in your Web space, which are not hyperlinked or reachable from a Web page hosted by us.
